1. The service

gist is operated by Myalt Retail Tech Private Limited ("Myalt", "we", "us"). References to "gist" in these terms mean the service; the contracting party is Myalt Retail Tech Private Limited.

gist provides a developer API that returns current cultural context for a topic. The context we return is assembled from third-party sources — publishers, marketplaces, brands and other publicly available material on the web — together with our own processing of that material. gist does not create the underlying source data, does not vouch for its accuracy, and does not guarantee that it is the most recent material available from any source.

By its nature the data is approximate and will contain some inaccuracies. It may contain errors introduced by the original source or by gist.

2. No warranty

gist expressly disclaims the accuracy, adequacy or completeness of any data returned by the service and shall not be liable for any errors, omissions or other defects in, delays or interruptions in, such data, or for any actions taken in reliance on it. Neither gist nor any of our data sources will be liable for any damages relating to your use of the data provided. The service is provided on an "as is" and "as available" basis.

You are responsible for reviewing any output before using it in a product, prompt or decision that affects your own users.

3. Accounts and API keys

You are responsible for all activity under your account and for keeping your API keys secret. Do not share keys, embed them in client-side code, or publish them. If you believe a key has been exposed, rotate it from the dashboard immediately and contact us. You must provide accurate account information and keep it up to date.

4. Acceptable use

You agree not to:

• Exceed, circumvent or attempt to circumvent the rate limits, quotas or plan allowances applied to your account, including by creating multiple accounts.
• Resell, redistribute or sublicense raw API responses as a substitute for the service itself, or use them to build a competing dataset or product.
• Reverse engineer, probe or interfere with the service, or attempt to gain unauthorised access to any part of it or to another customer's data.
• Use the service in a way that breaks any applicable law, infringes anyone's rights, or is intended to deceive, harass or defraud.

Automated use of the website (as distinct from the documented API) is not permitted without our express permission. We may suspend or terminate access for accounts that breach these terms.

5. Intellectual property

All brand names, logos, trademarks and images referenced through the service are owned by their respective owners. The gist name, website, dashboard, documentation and software are ours. Subject to these terms and your plan, we grant you a non-exclusive, non-transferable right to use API responses within your own applications.

6. Paid plans and payments

Some features are available only on paid plans. You must be at least eighteen (18) years old, or have reached the age of majority where you live, to make a purchase. If you are a minor, a parent or guardian must submit the payment information and authorise the transaction on your behalf. By submitting payment information you agree to pay all applicable transaction costs, including taxes and card or bank fees.

Payments are processed by a third-party payment gateway. gist only facilitates that gateway; it is operated by the provider and you are required to follow their terms as well. You represent that you have the right to use any payment method you submit, and you agree that gist shall not be liable for any losses — direct, indirect, incidental, punitive or consequential — arising from delays in processing a payment instruction or from card fraud. Complaints about payment processing may be raised with us and will be forwarded to the gateway provider for redressal.

Cancellation and refunds are covered by our Refund Policy. Personal data collected during payment is governed by our Privacy Policy.

We reserve the right to change, suspend, terminate or otherwise amend plan pricing at our discretion and at any time. Any such change is effective on posting to the site, and your continued use of the service afterwards is deemed acceptance of it.

7. Changes to these terms

gist reserves the right to make changes and improvements to these terms at any time and without notice. By using this site you acknowledge that you have read and agree to these terms, and do so at your own risk.

8. Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these terms or your use of the service.
